Rights & Responsibilities
Section 504 of the Rehabilitation Act of 1973 and the Americans
with Disabilities Act of 1990 guarantee equal access to all educational
programs and activities to qualified individuals with disabilities.
These provisions include services, special instruction, and accommodations
made to minimize the effects of the disability. It is important
to recognize, however, that this is not a guarantee of success.
It is a good faith effort to "level the playing field"
and provide an equal opportunity for student success … or failure.
ACCESS is the name used
by Moorpark College for the Disabled Student Program & Services
(DSP&S) of the California Community Colleges. The Board of Governors
believes that your education is important and your services and
accommodations are to be taken seriously. They define your rights
and responsibilities in the law. Title V of the California Code
of Regulations is quoted below.
56008.Student Rights
Participation by student with disabilities in Disabled Student Programs
and Services shall be entirely voluntary.
Receiving support services or instruction authorized under this
subchapter shall not preclude a student from also participating
in any other course, program or activity offered by the college.
All records maintained by DSP&S personnel pertaining to student
with disabilities shall be protected from disclosure and shall be
subject to all other requirements for handling of student records
as provided in Subchapter 2 of Chapter 5 of this Division.
56010.Student Responsibilities
Students receiving support services or instruction under this subchapter
shall:
comply with the student code of conduct adopted by the college and
all other applicable statutes and regulations related to student
conduct:
be responsible in their use of DSP&S services and adhere to
written service provision policies adopted by DSP&S; and
make measurable progress toward the goals established in the student's
Student Educational Contract or, when the student is enrolled in
a regular college course, meet academic standards established by
the college pursuant to Subchapter 8 of Chapter 6 of this Division.
A district may adopt a written policy providing for the suspension
or termination of DSP&S services where a student fails to comply
with subdivision a2 or a3 of this section. Such policies shall provide
for written notice to the student prior to the suspension or termination
and shall afford the student an opportunity to appeal the decision.
Each student shall be given a copy of this policy upon first applying
for services from DSP&S.
Students using ACCESS
services are expected to comply with the same conduct and academic
standards stated in the Moorpark College Catalog. Failure to make
"measurable progress" in ACCESS classes or mainstream
classes may result in academic probation and/or dismissal from the
college as outlined in the Moorpark College Catalog. Failure to
comply with ACCESS service agreements or contracts may result in
the interruption of services. No services will be altered or interrupted
without written notification and the opportunity to appeal the decision
to the ACCESS Coordinator. Any disagreement with decisions at this
level should be taken to the Moorpark College ADA/504 Coordinator.
Students may refer to the Moorpark College Catalog and follow the
outlined Student Grievance Procedures.
Although strongly suggested,
it is not required for a student to be registered with ACCESS in
order to use accommodations as outlined by Section 504 of the Rehabilitation
Act and the Americans with Disabilities Act. Students may apply
for accommodations directly through the campus ADA/504 Coordinator.
